Terms and conditions of the SAMMLER RECBORD shop newsletter<\/h2>\n\n\n\n

The pro\u00advi\u00adsions relat\u00ading to the Pre\u00adferred Entre\u00adpre\u00adneur apply to con\u00adtracts con\u00adclud\u00aded from 1 Jan\u00adu\u00adary 2021.<\/strong><\/p>\n\n\n\n

\u00a7 1 DEFINITIONS<\/strong><\/h3>\n\n\n\n

Con\u00adsumer<\/strong> \u2014 con\u00adsumer with\u00adin the mean\u00ading of the Civ\u00adil Code.
Newslet\u00adter<\/strong> \u2014 a ser\u00advice pro\u00advid\u00aded free of charge by elec\u00adtron\u00adic means, where\u00adby the Cus\u00adtomer may receive from the Ser\u00advice Provider by elec\u00adtron\u00adic means pre-ordered mes\u00adsages con\u00adcern\u00ading the Store, includ\u00ading infor\u00adma\u00adtion on offers, pro\u00admo\u00adtions and news in the Store.
Priv\u00adi\u00adleged trad\u00ader<\/strong>- an indi\u00advid\u00adual who enters into a con\u00adtract with the Ser\u00advice Provider that is direct\u00adly relat\u00aded to his or her busi\u00adness activ\u00adi\u00adty, but which is not pro\u00adfes\u00adsion\u00adal in nature for him or her (def\u00adi\u00adn\u00adi\u00adtion applic\u00ada\u00adble to con\u00adtracts con\u00adclud\u00aded from 1 Jan\u00adu\u00adary 2021 onwards).

\u00a7 2 Newsletter<\/strong><\/h3>\n\n\n\n
    \n
  1. The cus\u00adtomer can vol\u00adun\u00adtar\u00adi\u00adly use the Newslet\u00adter ser\u00advice.<\/li>\n\n\n\n
  2. In order to use the Newslet\u00adter ser\u00advice, a device with a web brows\u00ader in the lat\u00adest ver\u00adsion, sup\u00adport\u00ading JavaScript and cook\u00adies, with access to the Inter\u00adnet and an active e\u2011mail account is required.<\/li>\n\n\n\n
  3. Emails sent as part of this ser\u00advice will be sent to the email address pro\u00advid\u00aded by the Cus\u00adtomer when sign\u00ading up for the Newslet\u00adter.<\/li>\n\n\n\n
  4. In order to con\u00adclude an agree\u00adment and sign up for the Newslet\u00adter ser\u00advice, the Cus\u00adtomer shall pro\u00advide in the first step in the Store his\/her email address to which he\/she wish\u00ades to receive mes\u00adsages sent under the Newslet\u00adter. Upon sign\u00ading up for the Newslet\u00adter, a ser\u00advice agree\u00adment is con\u00adclud\u00aded and the Ser\u00advice Provider shall com\u00admence pro\u00advid\u00ading the ser\u00advice to the Cus\u00adtomer \u2014 sub\u00adject to sec\u00adtion 5.<\/li>\n\n\n\n
  5. For the prop\u00ader exe\u00adcu\u00adtion of the Newslet\u00adter ser\u00advice, the Cus\u00adtomer is oblig\u00aded to pro\u00advide his\/her cor\u00adrect e\u2011mail address.<\/li>\n\n\n\n
  6. Mes\u00adsages sent as part of the Newslet\u00adter will include infor\u00adma\u00adtion about the pos\u00adsi\u00adbil\u00adi\u00adty of unsub\u00adscrib\u00ading, as well as a link to unsub\u00adscribe.<\/li>\n\n\n\n
  7. The Client may unsub\u00adscribe from the Newslet\u00adter, with\u00adout giv\u00ading any rea\u00adson or incur\u00adring any costs, at any time using the option referred to in para\u00adgraph 6 or by send\u00ading a mes\u00adsage to the Ser\u00advice Provider\u2019s email address: sprzedaz@sammler.com.pl<\/a><\/li>\n\n\n\n
  8. If the Cus\u00adtomer uses the unsub\u00adscribe link from the Newslet\u00adter or sends a mes\u00adsage request\u00ading to unsub\u00adscribe from the Newslet\u00adter, this will result in imme\u00addi\u00adate ter\u00admi\u00adna\u00adtion of the con\u00adtract for the pro\u00advi\u00adsion of this ser\u00advice.<\/li>\n<\/ol>\n\n\n\n

    \u00a7 3 Complaints<\/strong><\/h3>\n\n\n\n
      \n
    1. Com\u00adplaints regard\u00ading the Newslet\u00adter should be report\u00aded to the Ser\u00advice Provider at the email address: sprzedaz@sammler.com.pl<\/a><\/li>\n\n\n\n
    2. The Ser\u00advice Provider will respond to the com\u00adplaint with\u00adin 14 days of receiv\u00ading the com\u00adplaint.

      OUT-OF-COURT COMPLAINT AND REDRESS PROCEDURES<\/strong><\/li>\n\n\n\n
    3. In the event that the com\u00adplaint pro\u00adce\u00addure fails to pro\u00adduce the result expect\u00aded by the Con\u00adsumer Cus\u00adtomer, the Con\u00adsumer may avail him\u00adself of, among oth\u00ader things:\n
        \n
      1. medi\u00ada\u00adtion con\u00adduct\u00aded by the local\u00adly com\u00adpe\u00adtent Voivod\u00adship Inspec\u00adtorate of Trade Inspec\u00adtion, to which a request for medi\u00ada\u00adtion should be sub\u00admit\u00adted. As a rule, the pro\u00adceed\u00adings are free of charge. The list of Inspec\u00adtorates can be found here: https:\/\/www.uokik.gov.pl\/wazne_adresy.php#faq595<\/a>;<\/li>\n\n\n\n
      2. with the assis\u00adtance of the com\u00adpe\u00adtent per\u00adma\u00adnent con\u00adsumer arbi\u00adtra\u00adtion court oper\u00adat\u00ading at the Provin\u00adcial Inspec\u00adtorate of Trade Inspec\u00adtion, to which a request for con\u00adsid\u00ader\u00ada\u00adtion of the case before the arbi\u00adtra\u00adtion court should be sub\u00admit\u00adted.       3. free assis\u00adtance from the munic\u00adi\u00adpal or dis\u00adtrict con\u00adsumer ombuds\u00adman;<\/li>\n\n\n\n
      4. ODR\u2019s online plat\u00adform avail\u00adable at: https:\/\/ec.europa.eu\/consumers\/odr\/main\/?event=main.home.howitworks<\/a>.<\/li>\n<\/ol>\n<\/li>\n<\/ol>\n\n\n\n

        \u00a7 4 Personal data<\/strong><\/h3>\n\n\n\n
          \n
        1. The admin\u00adis\u00adtra\u00adtor of the per\u00adson\u00adal data pro\u00advid\u00aded by the Cus\u00adtomer in con\u00adnec\u00adtion with the Newslet\u00adter sub\u00adscrip\u00adtion is the Ser\u00advice Provider. Detailed infor\u00adma\u00adtion on the pro\u00adcess\u00ading of per\u00adson\u00adal data by the Ser\u00advice Provider \u2014 includ\u00ading the oth\u00ader pur\u00adpos\u00ades and grounds for data pro\u00adcess\u00ading, as well as the recip\u00adi\u00adents of the data, can be found in the Pri\u00adva\u00adcy Pol\u00adi\u00adcy avail\u00adable at the Shop \u2014 due to the trans\u00adparen\u00adcy prin\u00adci\u00adple con\u00adtained in the Gen\u00ader\u00adal Data Pro\u00adtec\u00adtion Reg\u00adu\u00adla\u00adtion of the Euro\u00adpean Par\u00adlia\u00adment and of the Coun\u00adcil (EU) \u2014 \u201cRODO<\/strong>\u201d.<\/li>\n\n\n\n
        2. The pur\u00adpose of pro\u00adcess\u00ading the Cus\u00adtomer\u2019s data is to send the Newslet\u00adter. The basis for the pro\u00adcess\u00ading of per\u00adson\u00adal data in this case is the ser\u00advice con\u00adtract or actions tak\u00aden at the request of the Ser\u00advice Recip\u00adi\u00adent aimed at con\u00adclud\u00ading it (Arti\u00adcle 6(1)(b) RODO), as well as the legit\u00adi\u00admate inter\u00adest of the Ser\u00advice Provider con\u00adsist\u00ading in the pro\u00adcess\u00ading of data for the pur\u00adpose of estab\u00adlish\u00ading, inves\u00adti\u00adgat\u00ading or defend\u00ading pos\u00adsi\u00adble claims (Arti\u00adcle 6(1)(f) RODO).<\/li>\n\n\n\n
        3. Pro\u00advi\u00adsion of data by the Cus\u00adtomer is vol\u00adun\u00adtary, but at the same time nec\u00ades\u00adsary to pro\u00advide the Newslet\u00adter ser\u00advice. Fail\u00adure to pro\u00advide data means that the Ser\u00advice Provider will not be able to pro\u00advide this ser\u00advice.<\/li>\n\n\n\n
        4. The Ser\u00advice Recip\u00adi\u00aden\u00adt\u2019s data will be processed until:\n
            \n
          1. The cus\u00adtomer will unsub\u00adscribe from the Newslet\u00adter;<\/li>\n\n\n\n
          2. the pos\u00adsi\u00adbil\u00adi\u00adty for the Client or the Ser\u00advice Provider to assert claims relat\u00aded to the Newslet\u00adter ceas\u00ades;<\/li>\n\n\n\n
          3. the Clien\u00adt\u2019s objec\u00adtion to the pro\u00adcess\u00ading of his\/her per\u00adson\u00adal data is accept\u00aded \u2014 if the pro\u00adcess\u00ading was based on the legit\u00adi\u00admate inter\u00adest of the Ser\u00advice Provider<\/li>\n<\/ol>\n<\/li>\n<\/ol>\n\n\n\n

            - whichev\u00ader is applic\u00ada\u00adble in the case and which is the lat\u00adest.<\/p>\n\n\n\n

              \n
            1. The Cus\u00adtomer is enti\u00adtled to request:\n
                \n
              1. access to their per\u00adson\u00adal data,<\/li>\n\n\n\n
              2. their rec\u00adti\u00adfi\u00adca\u00adtion,<\/li>\n\n\n\n
              3. dele\u00adtions,<\/li>\n\n\n\n
              4. lim\u00adi\u00adta\u00adtion of pro\u00adcess\u00ading,<\/li>\n\n\n\n
              5. trans\u00adfer of data to anoth\u00ader con\u00adtroller
                as well as the law:<\/li>\n\n\n\n
              6. to object at any time to the pro\u00adcess\u00ading of data on grounds relat\u00ading to the Ser\u00advice Recip\u00adi\u00aden\u00adt\u2019s par\u00adtic\u00adu\u00adlar sit\u00adu\u00ada\u00adtion \u2014 to the pro\u00adcess\u00ading of per\u00adson\u00adal data con\u00adcern\u00ading him\/her based on Arti\u00adcle 6(1)(f) of the RODO (i.e. on the legit\u00adi\u00admate inter\u00adests pur\u00adsued by the con\u00adtroller).<\/li>\n<\/ol>\n<\/li>\n\n\n\n
              7. In order to exer\u00adcise their rights, the Client should con\u00adtact the Ser\u00advice Provider.<\/li>\n\n\n\n
              8. If the Ser\u00advice Recip\u00adi\u00adent con\u00adsid\u00aders that his\/her data is being processed unlaw\u00adful\u00adly, the Ser\u00advice Recip\u00adi\u00adent may lodge a com\u00adplaint with the Pres\u00adi\u00addent of the Data Pro\u00adtec\u00adtion Author\u00adi\u00adty.<\/li>\n<\/ol>\n\n\n\n

                \u00a7 5 Final provisions<\/strong><\/h3>\n\n\n\n
                  \n
                1. The Ser\u00advice Provider reserves the right to amend these terms and con\u00addi\u00adtions only for impor\u00adtant rea\u00adsons. An impor\u00adtant rea\u00adson shall be under\u00adstood to be the neces\u00adsi\u00adty to amend the reg\u00adu\u00adla\u00adtions due to mod\u00aderni\u00adsa\u00adtion of the Newslet\u00adter ser\u00advice or change of legal reg\u00adu\u00adla\u00adtions affect\u00ading the pro\u00advi\u00adsion of the ser\u00advice by the Ser\u00advice Provider.<\/li>\n\n\n\n
                2. Infor\u00adma\u00adtion about the planned change to the reg\u00adu\u00adla\u00adtions will be sent to the Cus\u00adtomer\u2019s e\u2011mail address pro\u00advid\u00aded at the time of sub\u00adscrib\u00ading to the Newslet\u00adter at least 7 days before the change is imple\u00adment\u00aded.<\/li>\n\n\n\n
                3. If the Ser\u00advice Recip\u00adi\u00adent does not object to the planned changes by the time they come into effect, he will be deemed to have accept\u00aded them.<\/li>\n\n\n\n
                4. If the Client does not accept the planned changes, he\/she should send infor\u00adma\u00adtion to the Ser\u00advice Provider\u2019s e\u2011mail address: bok@sammler.com.pl<\/a>, which will result in the ter\u00admi\u00adna\u00adtion of the ser\u00advice con\u00adtract when the planned changes come into effect.<\/li>\n\n\n\n
                5. The pro\u00advi\u00adsion of unlaw\u00adful con\u00adtent by the Cus\u00adtomer is pro\u00adhib\u00adit\u00aded.<\/li>\n\n\n\n
                6. The Newslet\u00adter ser\u00advice con\u00adtract is con\u00adclud\u00aded in the Pol\u00adish lan\u00adguage.<\/li>\n\n\n\n
                7. In the case of a Cus\u00adtomer who is not a priv\u00adi\u00adleged Cus\u00adtomer, the com\u00adpe\u00adtent court will be the court with juris\u00addic\u00adtion over the reg\u00adis\u00adtered office of the Ser\u00advice Provider.<\/li>\n<\/ol>","protected":false},"excerpt":{"rendered":"
